Probate

The process of proving a Will is valid and thereafter administering the estate of a dead person according to the terms of the Will. The first step is to file the purported will with the clerk of the appropriate court in the country where the deceased person lived, along with a petition to have the court approve the Will and appoint the executor named in the Will (or if none is available, then an administrator) with declarations of a person who had signed the will as a witness. If the court determines the Will is valid, the court then ‘admits’ the Will to probate.Probate means, authentication of a Will, authentication proceeding, judicial validation of a will, confirm the validity of a will, confirm the validity of a will, verify a testament.

Letter of Administration

A formal document nominating a specified person to take over, administer and dispose of an estate when there is no executor to carry out the testator’s will.
A document issued by the probate court or some officer who has authority, directing a person to administer the goods or property of a dead person.Court order authorizing a person (called ‘administrator’ if male; or ‘administratrix’, if female) to manage or distribute the property of a deceased who did not make any such arrangement in his or her will, or died intestate (without making a will).

Succession Certificate

A succession certificate is issued by a civil court to the legal heirs of a deceased person. If a person dies without leaving a will, a succession certificate can be granted by the court to realize the debts and securities of the deceased. It establishes the authenticity of the heirs and gives them the authority to have securities and other assets transferred in their names as well as inherit debts.
